El fraude ocurre cuando alguien engaña a otra persona para obtener dinero o un beneficio indebido. Un caso muy común es cuando se entrega dinero con la promesa de recibir un terreno, condominio o casa y, con el tiempo:
- The promised property is never built,
- It is delivered incomplete, or
- It is never delivered at all.
In all these cases, you have been a victim of fraud.
De acuerdo con el artículo 214 del Código Penal de Sinaloa, el fraude puede castigarse con hasta 10 años de cárcel para quien:
By deceiving someone or taking advantage of the error in which they find themselves, unlawfully obtains someone else’s property or secures an undue benefit for themselves or another.”
This means that if someone received money from you (whether the full amount or a partial payment) with the promise of selling you a property but never fulfilled the agreement, they probably intended from the beginning to keep your money. In such a case, that person may be prosecuted and forced to return your money as compensation for damages.
The same applies when you pay for remodeling or services in your home and do not receive what was promised: the materials never arrive, the work is of poor quality, or the contract is simply not fulfilled.
